HIPAA CONFIDENTIALITY OF MEDICAL RECORDS: Legal Issues Regarding Patient Privacy

Location and Cost

The seminars are held at the Thompson Conference Center on the University of Texas campus at Dean Keaton (26th) and Red River, directly north of the LBJ Library. The cost is $200. (Registration begins at 12:30 p.m., but preregistration is advised as seating is limited. Please arrive one-half hour before start time. Free parking is provided in the Thompson Conference Center lot.

Program Summary

The Privacy Regulations of the Health Insurance Portability and Accountability Act of 1996("HIPAA") regulate what health care professionals can do with protected health information ("PHI"), generally restricts its use to Treatment, Payment and Health Care Operations ("TPO"), and provides a whole host of other administrative requirements. Criminal penalties are even a possibility for non-compliance. This seminar will acquaint attendees with the basic requirements of HIPAA and provide tips for compliance.

Seminar Agenda

  • Registration (30 minutes)
  • Hours One & Two:
    • Welcome & Introduction (5 minutes)
    • HIPAA Privacy Regulation Overview, Important Definitions and Permitted and Required Uses - What are the HIPAA Privacy Rules and Where did they come from? Who is covered by HIPAA and Who isn't? What can you do with patient information now? (25 minutes)
    • Use of PHI for TPO; Authorization to Use PHI for Other Purposes What do you have to do in order to receive and use patient information under HIPAA? What forms are necessary? (45 minutes)
    • Business Associate Contracts - What HIPAA requirements apply to your billing service, accountant or lawyer? What must these contracts say? (30 minutes)
  • Break (15 minutes)
  • Hours Three & Four:
    • Notice of Privacy Practices - Is a privacy policy required? What do you tell patients about your privacy policy? (15 minutes)
    • Patient's Right to Inspect and Amend Records - What legal rights do patients have to their medical records? (15 minutes)
    • Accounting for Disclosures of PHI - How do you keep track of to whom you release records? (15 minutes)
    • Privacy Official - Who is responsible for HIPAA compliance in your office? What must they do? (15 minutes)
    • "Texas HIPAA" - Implications of Senate Bill 11 - What does Texas' new HIPAA law mean? (15 minutes)
    • HIPAA Security Overview - What security measures are required? (30 minutes)
    • HIPAA Enforcement Provisions and Question & Answer Period - How can someone violate HIPAA? What happens if they do? (15 minutes)
  • The program is 240 minutes. Attendees will receive a certificate of completion.

This seminar is designed for Texas health care providers, including but not limited to: physicians, podiatrists, dentists, chiropractors, optometrists, hospital administrators, physical therapists, nurses, medical records directors, medical records clerks, medical records coders, practice administrators and managers, office managers, surgical centers, audiologists, therapists, ocularists, orthotists, prosthetists, and long-term care facilities. It is also designed for advisors of providers, including but not limited to lawyers, paralegals, management consultants, practice consultants, accountants, software developers, computer consultants, anti-fraud consultants, and document retention and destruction companies.

Each registrant will receive a set of materials prepared by the faculty specifically for this seminar, which will serve as a valuable future reference.

Confirmation:

Registration is not complete until we receive payment. We will acknowledge your payment with a receipt to the fee payer. If you do not receive a receipt, call the registrar to confirm your registration.

Refunds:

We regret we cannot process refunds. Registrants holding confirmed session space may send a substitute, if three working days prior notification is received. If a Registrant cannot attend, with one working day prior notification, the Registrant may transfer the tuition paid to be credited for attendance at a scheduled Texas Medical-Legal Report Seminars seminar for a $25 rescheduling fee.
